Terms & Conditions

General

The General Terms and Conditions have been drawn up in accordance with consumer protection regulations, based on the recommendations of the Chamber of Commerce and Industry of Slovenia and international codes for online and electronic commerce.

The buyer is bound by the general terms and conditions that are valid at the time of purchase (submission of an online order). When placing an order, the user is each time specifically reminded of the general terms and conditions of business and confirms his/her familiarity with them by submitting an order.​

 

These General Terms and Conditions define the operation of the online store, the rights and obligations of the visitor, user and buyer, and the business relationship between the Merchant and the user as a buyer of products from the online store's offer.

Accessibility of information

The Merchant undertakes to always make available to the user:

Data on the identity of the Merchant; contact information that enables the user to communicate quickly and efficiently with the Merchant (email address, telephone number, etc.); information on the essential characteristics of the products offered by the online store, including any guarantees (if there is no guarantee written next to the product, there is no guarantee for that product); information on prices, which must be clearly specified and it must be clear whether the price already includes VAT or not information on the availability of products offered by the online store; method and conditions of delivery of products or performance of services, in particular the place and time of delivery; information on the method of payment; information on the time validity of the offer from the online store; information on the period within which it is still possible to withdraw from the contract and the conditions for withdrawal; information on the possibility of returning products or withdrawing from the contract information on the procedure for a user complaint and information on the Merchant's contact person for contacts with users.

Our Terms & Conditions cover essential aspects such as the proper usage of our website, payment methods, product warranties, intellectual property rights, and our policies on account suspension or cancellation. Payment methods

The Merchant offers the user the following payment methods for purchasing products from the Barking Buds online store:

PAYMENT WITH PAYMENT CARDS*: is made via the Stripe payment system. Card information is not recorded on the company's server, so your security is 100% guaranteed. Stripe ensures maximum transaction security. Credit card authorizations are performed in real time with immediate verification of data with banks. Payment is possible with the following cards: Mastercard, Visa, America Express, Discover, Diners, JCB and Maestro (if the payer's Maestro payment card allows this).

 

PAYPAL*: Secure payment via PayPal.

* The payment amount already includes shipping and other delivery costs.

Prices

The online price applies to all registered users of the Merchant's online store. All prices in the online store are listed in euros. All prices in the online store are product prices and do not include delivery costs (see points 3 and 12). All prices apply only to electronic orders of products through the online store. Discounts are not cumulative, promotions are mutually exclusive, unless expressly stated otherwise. All prices are valid at the time of placing the order and do not have a predetermined validity period, therefore they are valid only until they are changed. Despite the Merchant's extraordinary efforts to provide the most up-to-date and accurate information, it may happen that the price information is incorrect. In the case referred to in the previous sentence and in the event that the price of the product changes during the processing of the order, i.e. from the moment of placing the order until the order confirmation, the Merchant will:

• notify the user (buyer) of this and inform him/her of the new prices, in such a case the user (buyer) has the option to change his/her order or cancel it in part or in full or confirm the order at the new prices, all without additional costs; or • enable the user (buyer) to withdraw from the purchase and at the same time offer him/her a solution that will be of mutual benefit and satisfaction. Funds paid under vouchers, other bonuses and pro forma invoices do not bear interest. The price of goods in the online store is not adjusted based on automated decision-making.

Purchase process

Order accepted

After placing the order, the user (buyer) receives a notification from the Merchant by e-mail that the order has been accepted. The user (buyer) has the option to cancel the order without consequences until the order is shipped. Apart from the option of cancellation, the user (buyer) cannot change the content of the order after placing the order.

 

Order confirmed

If the user (buyer) does not cancel the order, the order will be processed further. Upon receipt, the Merchant reviews the order, checks the availability of the ordered products and confirms the order or rejects it with a reason. All products are handmade. The Merchant has up to 14 days to ship the order. If processing time is longer the Merchant has to inform the buyer. The Merchant may also contact the user (buyer) by phone at the contact phone number provided to verify the data or ensure the accuracy of the delivery.

 

Goods shipped

The merchant prepares and ships the ordered products within the agreed deadline and notifies the user (buyer) of this by email.

Purchase Agreement and Issuance of Invoice

The Merchant shall issue an invoice in written or electronic form to the User who purchases a product from the online store, with itemized costs. The purchase agreement in the form of a purchase order is stored in electronic form on the Merchant's server.

Coupons, gift certificates, vouchers and loyalty programs

You can use online store coupons with a password you have obtained or published. To use a coupon, you must first select the desired product(s), then click on the cart and select "View cart". The option "Use coupon code" will appear, where you enter your password in the field and click "Use coupon". The program will automatically calculate the discount at the end of the purchase.

Right to withdraw from purchase, return of products

In accordance with the Consumer Protection Act (ZVPot-1), in contracts concluded at a distance or outside business premises, the consumer has the right to notify the company within 14 days that he withdraws from the contract, without having to state the reason for his decision. The consumer can submit the notice of withdrawal to the company on a form or with an unambiguous statement from which it is clear that he withdraws from the contract (it can also be oral, e.g. given by telephone). The consumer is deemed to have submitted the withdrawal statement on time if it is sent within the deadline set for withdrawal from the contract. In connection with withdrawal from the contract, the consumer only covers the costs of returning the goods. The consumer is liable for any decrease in the value of the goods if the decrease in value is the result of conduct that is not strictly necessary to determine the nature, properties and functioning of the goods.

We recommend that you use a delivery service that allows tracking of the shipment and that you prepare the goods appropriately for transport (you can use the original packaging or other suitable safe packaging). Any return costs are covered by the buyer. We do not accept shipments with a ransom. In the event of withdrawal from the contract, the company shall immediately return all payments received or at the latest within 14 days of receiving the notification of withdrawal from the contract. The company shall return the payments received to the consumer using the same means of payment as the consumer used, unless the consumer has expressly agreed to use another means of payment and the consumer does not bear any costs as a result. The consumer is not entitled to reimbursement of additional costs incurred if he has expressly opted for a type of shipment other than the most affordable standard shipment offered by the company. In the case of a sales contract, the company may withhold the refund of payments received until the returned goods have been received or until the consumer provides proof that he has sent the goods back, unless the company offers the option of collecting the returned goods himself.

Material defect and warranty

The seller is liable for any non-conformity of the goods that exists at the time of delivery of the goods.

Delivery

We deliver Worldwide. The Merchant will deliver the ordered products to the user (buyer) within the agreed deadline. The Merchant's contractual partner for the delivery of shipments is Pošta Slovenije, kurirska in paketna distribucija, d.o.o. The Merchant reserves the right to choose another delivery service if this will enable the order to be fulfilled more efficiently.

The delivery deadline for products that are in stock, for delivery addresses in Slovenia, is expected to be the next working day or up to 2 working days for orders placed after 12 noon. The flat rate delivery price is €4.90 per package. The price includes the costs of order processing, packaging costs and delivery costs. Each product from the online store is available within a reasonable time and is dispatched in the shortest possible time. Allow up to 14 days for custom orders to be made and shipped.

Communication and e-news

The trader will contact the user (buyer) using distance communication, unless the user (buyer) expressly objects to this.

Child Protection

The online store merchant shall not accept orders from anyone known or suspected to be a child without the express permission of the child's parents or guardians. The online store merchant shall not offer free access to products or services that are harmful to children. The online store merchant shall not accept any personal data concerning children without the express permission of the parents or guardians, nor shall it disclose data received from children to third parties other than the parents or guardians. Any communication addressed to children shall be appropriate to their age and shall not exploit children's trustworthiness, lack of experience or sense of loyalty.

Limitation of liability

The risk of loss or damage to the goods shipped shall pass from the company to the consumer when the goods are physically received by the company or when the goods are physically received by a third party other than the carrier and designated by the consumer for this purpose.

 

If the consumer has ordered transport from a carrier not offered by the company, the risk of loss or damage to the goods shall, notwithstanding the previous paragraph, pass to the consumer upon delivery of the goods to the carrier, without prejudice to the rights of the consumer against the carrier.

Products not picked up

The buyer is obliged to pick up the ordered items within a certain period of time from the receipt of the electronic notification about the completed order, SMS confirmation of the completed order or confirmation by e-mail. If the buyer does not collect the ordered items and they are returned to the company's address, this is NOT considered a withdrawal from the contract, as the latter is still validly concluded and it is a unilateral unannounced withdrawal of the buyer from the contract. In the event of non-collection, the buyer is thus responsible for paying the costs of additional shipping/return of the items to the company. In the event of non-collection, the case will be handed over to the legal department, which will, under our authorization, further arrange the payment and recovery of the incurred costs and damage.

Complaints, disputes and application of law

The trader complies with applicable consumer protection regulations. The trader has an effective complaints handling system in place and has a designated person with whom the user (buyer) can contact by e-mail in case of problems.

 

In case of problems, the user (buyer) can submit a complaint to the e-mail address: info@barkingbuds.net. The complaint handling procedure is confidential.

The Merchant will confirm receipt of the complaint within five working days and inform the user (buyer) of how long it will take to process it and keep them informed about the progress of the procedure. The Merchant will make every effort to resolve any disputes amicably. If an amicable resolution of the dispute is not reached, the court in Slovenia  shall have exclusive jurisdiction to resolve all disputes between the Merchant and the user (buyer). The Merchant and the user (buyer) as participants in electronic commerce mutually recognize the validity of electronic messages in court. These General Terms and Conditions and all disputes between the Merchant and the user (buyer) shall be governed and applied by Slovenian substantive and procedural law, with the rules of private international law that would indicate the application of any other law not being applied. The provisions of the Code of Obligations, the Electronic Commerce Act, the Personal Data Protection Act and the Consumer Protection Act shall apply mutatis mutandis to all relationships and rights and obligations not regulated by these General Terms and Conditions.

Changes to the General Terms and Conditions

In the event of changes in regulations governing the operation of online stores, data protection and other areas related to the operation of the online store of the Merchant and in the event of changes to its own business policy, the Merchant may change and/or amend these General Terms and Conditions, of which it will inform users in an appropriate manner each time. Any changes and/or amendments to the General Terms and Conditions shall enter into force and apply upon the expiry of a period of eight days from the publication of the changes and/or amendments. If a change and/or amendment to the General Terms and Conditions is necessary to comply with regulations, these changes and/or amendments may exceptionally enter into force and apply in a shorter period. ​A user who does not agree with the changes and/or amendments to these General Terms and Conditions must cancel their registration within eight days of the publication of the notice of change and/or amendment to the General Terms and Conditions, otherwise, after the expiry of this period, it shall be deemed, and no evidence to the contrary shall be admissible, that the user accepts the changes and/or amendments to the General Terms and Conditions. Cancellation of registration shall be made by the user notifying the Merchant of the cancellation in writing.
